Former AirAsia X pilot who was fired for "anxiety." loses claim for unfair dismissal

 

A pilot who claimed he was wrongfully fired for having anxiety has been unsuccessful in his legal action against AirAsia X. 


Eswary Maree, the chairperson of the Malaysian Industrial Court, was unmoved by the former pilot's argument and came to the conclusion that his dismissal was justifiable in the circumstances.  


The pilot joined AirAsia X in October 2019 but was let go two and a half years later because of his nervousness, according to Free Malaysia Today. 


The airline reportedly gave the claimant significant help, medical leave, examinations, and training for more than a year, but his anxiety persisted, according to testimony in court.  


Lawyers for the pilot said that their client underwent "assessment after assessment."  The claimant had argued that his issues were “minor.” 


The chairperson defended the airline, claiming that a clinical psychologist had advised the training sessions as being necessary to determine the pilot's fitness to fly. 


Because of concerns for the safety of everyone on board, the company "could not treat lightly the claimant's fitness to resume flying, including his mental state," Eswary Maree said. 


The claimant continued to exhibit signs of anxiety during training sessions in August and September 2019, and he was informed that this could result in his termination from the airline.  


Eswary Maree claimed that AirAsia X had sincerely helped the pilot and was dedicated to assisting him in getting back in the air.   


In light of the claimant's continuous anxiety, the chair concluded that the airline had every right to end the contract.  


"Continued employment posed risks, and the company could not reasonably be expected to accept such a situation," Eswary Maree stated. The company's top priority as an airline was to ensure air safety. He was actually unfit to continue his flight duties based on the contemporaneous evidence that was given to this court.
